These Terms & Conditions (“Terms”) govern your use ofthe SWIFTLET NEST, LLC website at www.swiftletnest.com and our services,including participation in our online sweepstakes and skill-based games. Byaccessing this website, you accept these Terms in full. Do not continue to useSWIFTLET NEST, LLC if you do not agree to all of the Terms stated on this page.Your participation is also subject to our Sweepstakes Rules, Privacy Policy,Responsible Gaming Policy, and Refund & Cancellation Policy, each of whichis incorporated by reference.

2. Eligibility

•    You must be at least 18 years of age to registeror participate.

•    Participation is open only to legal residents ofthe United States (excluding residents of California, Connecticut, Idaho,Indiana, Louisiana, Michigan, Montana, Nevada, New Jersey, New York, Tennessee,and Washington) and Canada (excluding Quebec).

•    Employees of SWIFTLET NEST, LLC, their immediatefamily members, and household members are not eligible to participate.

•    Access is restricted in jurisdictions where ourgames are prohibited or restricted; we use state gating and geolocationcontrols to enforce eligibility.

3. Participation

•    No purchase or payment is necessary to enter orwin a sweepstakes, and a purchase will not improve your chances of winning. Afree alternative method of entry is described in the applicable SweepstakesRules.

•    You may enter by completing the entry form onour website or by using the free alternative method of entry where offered.

•    Entry limits are specified in the SweepstakesRules for each promotion.

4. Accounts

•    You are responsible for maintaining theconfidentiality of your account credentials and for all activity under youraccount.

•    You agree to provide accurate, currentinformation and to complete identity and age verification (KYC) when requested.We may suspend or close accounts that cannot be verified or that violate theseTerms.

•    One account per person. Duplicate, fraudulent,or shared accounts may be disqualified or closed.

5. Purchases & Payments

Where youchoose to purchase entries, credits, or virtual items, payment is processed byour third-party payment providers. All purchases are handled in accordance withapplicable law, card-network rules, and our Refund & Cancellation Policy.Purchases of virtual items confer a limited, revocable license to use themwithin the platform and have no cash value except as expressly provided.

6. Sweepstakes Rules

•    The specific rules for each sweepstakes,including the prize, entry period, and method of entry, are provided on theapplicable sweepstakes entry page and in the Sweepstakes Rules.

•    All entries must be received by the stateddeadline. Winners are selected from all eligible entries in accordance with theapplicable rules.

7. Prizes

•    Prizes are specified in the applicableSweepstakes Rules and are non-transferable. No cash or other substitution ispermitted except at our discretion or as required by law.

•    Prize awards and payouts are subject to identityverification and applicable payout limits. Winners are notified using thecontact details provided at entry.

8. Taxes

Winners aresolely responsible for all federal, state, and local taxes and fees associatedwith the receipt or use of any prize. We may issue tax forms and withhold whererequired by law.

9. Privacy

10. Intellectual Property

SWIFTLET NEST,LLC is not responsible for any errors, technical or network failures, or anyinjury or damage to participants or any other person’s device related to orresulting from participation. To the fullest extent permitted by law, ouraggregate liability is limited, and we are not liable for indirect, incidental,or consequential damages.

13. Indemnification

You agree toindemnify and hold harmless SWIFTLET NEST, LLC, its affiliates, officers,directors, employees, and agents from any claims, losses, or damages arisingout of your use of the platform, your entries, or your violation of theseTerms.

14. Dispute Resolution & Arbitration

Any disputesarising out of or relating to these Terms or the sweepstakes shall be resolvedthrough binding arbitration administered by the American ArbitrationAssociation, on an individual basis and not as a class action, except whereprohibited by law. You may opt out of arbitration as described in any separatearbitration notice we provide.

15. Amendments

We reserve theright to amend these Terms at any time. Amendments will be posted on this pageand are effective immediately upon posting. Your continued use constitutesacceptance of the updated Terms.

16. Governing Law

These Terms aregoverned by and construed in accordance with the laws of the State of Delaware,without regard to its conflict-of-law principles.
